Sidewalk Clearing Enforcement
Sidewalks serve an important public safety function. Accordingly, at noon on Sunday, February 1, 2026 the Berryville Police will begin enforcement of sidewalk clearing requirements in accordance with § 15-16 of the Berryville Code.
Removal of Snow and Ice from Sidewalks
In accordance with § 15-16 of the Berryville Code, Town residents and property owners are responsible for clearing the sidewalks adjacent to their property. If the total accumulation of snow, sleet, or ice is less than six inches (6”), owners and residents must clear the sidewalks within twelve (12) hours after the precipitation has ceased to fall. If the total accumulation is greater than six inches (6”), owners and residents have twenty-four (24) hours to clear the sidewalks. If the accumulation is difficult to remove without damaging the pavement, then material that renders the sidewalk safe for foot traffic must be applied within twelve (12) hours after the precipitation ceases.
If upon inspection a patrol officer observes a violation of § 15-16 of the Berryville Code, then the officer will issue a compliance notice (posted on the property) for the property in question. If the condition that precipitated the issuance of the compliance notice is not abated within eight (8) hours of the issuance of the notice, then the Town may cause work to be completed to place the sidewalk section into compliance with applicable law.
If the Town causes work to be completed on a sidewalk section, then the cost of that work will be charged to the property owner.
Please be aware that materials removed from sidewalks may not be deposited on streets or sidewalks.
Prohibition Against Depositing Snow on Roadways or Sidewalks
In accordance with § 15-17 of the Berryville Code, snow, sleet, and ice removed from the sidewalk may not be deposited on roadways or sidewalks. Doing so hinders clearing operations and can create roadway hazards on streets that may have already been cleared.
Directing the flow of snow, sleet, or ice from a snow blower onto roadways or sidewalks deposits that material on the surface in question and therefore constitutes a violation of § 15-17 of the Berryville Code.
The Town recognizes that the low temperatures in our area increase the difficulty of removing snow and ice from sidewalks. Property owners are required to clear sidewalks and if ice and the like that has adhered to the walk prove too difficult to remove without damaging the walk, then they must apply material (such as snow melt with abrasives or sand) to the cleared path that renders the sidewalk safe for foot traffic.
